We process your personal data for the following purposes:

It appears from the Offshore Safety Act, section 50:

(1) Before work is commenced on an installation, the operator and the owner, respectively, shall ensure that the employees are sufficiently trained to attend to the tasks according to the internal emergency response plan of the installation, cf. section 45 of the Act, and to attend to their own safety in an emergency situation.

(2) The employer shall ensure that the employees are adequately instructed, and that they have the competences to ensure that their duties on the installation can be performed in such a way that the health and safety risks and risks of major environmental incidents are reduced to a level as low as reasonably practicable, including that documentation for these competences is available.

(3) Persons under the age of 18 may not carry out work on installations.

(4) The Minister for Employment may lay down regulations on training pursuant to subsection (1) and on the necessary competence pursuant to subsection (2).

• for permanent work - section 3 and section 5, 

• for temporarily work - section 4 and section 6, and

• for the collection of personal information - section 7,  section 9 and section 13.

Legal basis in EU directive(s) on the mutual recognition of professional qualifications

2005/36/EC, title III, chapter I (General system for the recognition of evidence of training).

We process the following categories of personal data about you:  

General information including: 

• Identification information regarding individuals and companies.

• CPR number.

• Social security number.

The personal information usually comes from the employer or employee. A sometimes from a third party.

Currently, the Danish Work Environment Authority cannot say how long your personal data will be stored in connection with this processing of applications. However, we can inform you that we will emphasize that we only store your personal data as long as it is necessary to fulfil our obligations in accordance with Danish law and EU legislation.

We employ automatic assessments, such as profiling, in order to target which companies is the most likely to have a problem with the work environment. 

There are no automatic assessment or profiling taking place in relations to this assignment.

As the Danish Work Environment Authority are gathering most personal data on the basis of our legislative obligations in accordance to Danish law, most of the collecting of data will not be based on a specific consent from you. When this is the case, a withdrawal of consent will rarely result in the Danish Work Environment Authority terminating any gathering or treating of your data. This is because your rights to not have data gathered and treated must be weighed against e.g. the countries right to a safe work environment.

Pursuant to the General Data Protection Regulation, you have several rights in relation to our processing of data concerning you. If you wish to exercise your rights, you must contact us.  

Right of access 

• You have the right to obtain access to the data we process concerning you, together with a number of other data.  

 Right to rectification (correction) 

• You have the right to have incorrect data concerning you rectified.  

 Right to erasure 

• In special cases, you have the right to have data concerning you erased before the time of our ordinary general erasure.  

 Right to restriction of processing 

• In certain cases, you have the right to restrict the extent to which we process your personal data. If you have the right to restrict processing, we will henceforth only process information with your consent – with the exception of storage – or if a legal claim can be established, exercised or defended, or to protect a person or important public interests.   

Right to object 

• In certain cases, you have the right to object to our processing of your personal data.  

 Right to transmit data (data portability)  

• In certain cases, you are entitled to receive your personal data in a structured, commonly used and machine-readable format, and to have this personal data transmitted from one data controller to another without hindrance.
