We process your personal data for the following purposes:

• The personal data are used to assess whether the fitter, workshop or vehicle manufacturer or its owner and/or day-to-day manager meets the criteria for obtaining an authorization, including a code of conduct requirement.

The basis in law for our processing of your personal data ensues from:

• Article 7 and article 24 of regulation (EU) No 165/2014 of the European Parliament and of the Council of 4 February 2014 on tachographs in road transport, repealing Council Regulation (EEC) No 3821/85 on recording equipment in road transport and amending Regulation (EC) No 561/2006 of the European Parliament and of the Council on the harmonization of certain social legislation relating to road transport.

• Section 2 of Bekendtgørelse nr. 1318 af 22. november 2018 om autorisation til installering, eftersyn, kontrol og reparation af takografer (værkstedsautorisationsbekendtgørelsen).

• Act on supplementary provisions to the regulation on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (the Data Protection Act), Act No. 502 of 23 May 2018

• General Data Protection Regulation (GDPR), EU 2016/679 article 6(1)(e) and article 9(2)(g)

• The Danish Road Traffic Authority complies with The Danish Freedom of Information Act and the Public Administration Act.

We process the following categories of personal data about you:

• Personal data – such as your name, address, identification number, education and qualification, employment.

• Special data – approval report.

• Personal data relating to criminal convictions and offences, which is of importance for our decision regarding your application.

We disclose your personal data or make it available to the following recipients:

• The police.

• The Danish Road Traffic Authority uses data processers for filing of cases and receiving applications.

Usually we will receive data from you, when receiving your application. Other sources may be:

• Publicly available sources

• The police

• Educational institutions

• Supervision companies

Currently, we cannot say how long we will keep your personal data. However, we can inform you that we will emphasise the rules and principles of the Danish Archives Act, The Danish Freedom of Information Act and the Public Administration Act and how long your data is necessary for the case when determining how long the data will be kept.

If personal information about you has been submitted, you have the right to withdraw your consent at any time. This can be done by contacting us.

If you choose to withdraw your consent, it does not affect the lawfulness of our processing of your personal data based on your previously given consent and up to the time of the withdrawal. Therefore, if you withdraw your consent, it will only take effect from this time.

Pursuant to the General Data Protection Regulation, you have several rights in relation to our processing of data concerning you. If you wish to exercise your rights, you must contact us.

Right of access

You have the right to obtain access to the data we process concerning you, together with a number of other data.

Right to rectification (correction)

You have the right to have incorrect data concerning you rectified.

Right to erasure

In special cases, you have the right to have data concerning you erased before the time of our ordinary general erasure.

Right to restriction of processing

In certain cases, you have the right to restrict the extent to which we process your personal data. If you have the right to restrict processing, we will henceforth only process information with your consent – with the exception of storage – or if a legal claim can be established, exercised or defended, or to protect a person or important public interests.

Right to object

In certain cases, you have the right to object to our processing of your personal data.

Right to transmit data (data portability)

In certain cases, you are entitled to receive your personal data in a structured, commonly used and machine-readable format, and to have this personal data transmitted from one data controller to another without hindrance.
