How we process personal data

Introduction

When you communicate with The Fund as a personally owned company, The Fund will process information about you as part of it's case processing. This information is also called personal data.

When does The Fund process the data?

The Fund processes cases about you in connection with:

  • Covering wages owed to wage earners posted in Denmark in connection with providing services.

  • Collection of contributions on the basis of your registration in RUT.

  • Recognition and collection via domestic courts in your country of registration of wages owed as determined by an industrial tribunal decision in Denmark.

  • Collection of extraordinary contributions when The Fund has paid wages to your employees.

  • If you are included in the list of employers which have not paid wages to their employees and The Fund has paid wages to them.

If you contact The Fund without a case

If you contact The Fund without having a case, your inquiry will be registered, including, for example, your name and contact details. If The Fund subsequently receives a claim for wages owed, you will be notified of the information involved in the processing of the case.

What type of data will be processed?

The Fund only collects and processes the data necessary for processing the case.

What type of data can be processed?

The Fund can process the following data:

  • Corporate identity, ownership and registration in RUT

  • Corporate address

  • The identity of posted wage earners

  • Contractual relationships, for example, the identity of Danish principals

  • Industrial tribunal decisions and settlements to which you are a party

  • A complete or partial compliance with decisions or settlements .

The information can also be gained from the RUT register, the Danish Tax Agency, foreign employers and labour unions.

How does The Fund process your personal data?

The Fund processes your personal data on the basis of The Danish Labour Market Fund for Posted Workers. The Fund may disclose information about you to other public authorities such as the Danish Tax Agency, Udbetaling Danmark – Public Benefits Administration or banks which pursuant to legislation are entitled to receive the information. The Fund will store your data during the processing of your case and delete them after 10 years. After the case has been processed, the data are stored on the basis of documentation requirements as stipulated in, for example, the Danish Bookkeeping Act and the Danish Access to Public Administration Files Act. If you call The Fund, you may be asked if The Fund can record the call. The recordings are used solely for training staff and improving the customer experience. The conversation is deleted after two months, but you can always have the conversation deleted earlier by contacting The Fund.

What are your rights?

You may object to The Fund storing your personal data. You can receive a copy of the data that The Fund has about you. You may also request:

  • to have your personal data rectified or erased

  • to have the data sent to you or someone else

  • that The Fund suspends the processing of your data.

If you ask to have your personal data erased, it is not certain that The Fund will comply with your request. This may be the case, for example, because your personal data form part of a case to recover wages owed or extraordinary contributions from a third party or due to statutory requirements.

Dissatisfied with the processing of your personal data?

You can contact the Data Protection Officer, if you think:

  • that you have not received a satisfactory response to your request for access to your personal data

  • that The Fund has not respected your rights.

Contact the Data Protection Officer (at LifeinDenmark.dk) If you disagree with the way in which The Fund processes your personal data, you may file a complaint to the Danish Data Protection Agency. Please note that the Danish Data Protection Agency is only handling complaints regarding The Fund's processing of personal data.
