How we process personal data

As an owner of a personally owned company, here you can learn about what data Barsel.dk processes, how the data is processed and what rights you have when we process cases and inquiries concerning:

  • The awarding of compensation during leave

  • Collection of contributions to finance Barsel.dk

Barsel.dk is responsible for the processing of the personal data that we have about you.

Why Barsel.dk processes your personal data

We process your personal data for the following purposes:

  • To ensure that you can receive compensation from Barsel.dk if you are on maternity/paternity leave and that we can calculate reimbursement/compensation to others related to a child that you are the parent of or have been on maternity/paternity leave with.

  • To ensure that Barsel.dk can decide on the obligation to pay contributions as a self-employed person and collect these contributions.

  • To train our employees and improve the customer experience (if you call us and accept that we can record the conversation).

  • To test our systems in connection with development, optimisation of operations and, if relevant, fixing errors.

What type of data do we process?

We only collect information about you that we need to process your case. We collect the following types of personal data about you:

  • We receive information about the child and parents’ social security numbers and other basic data from the Danish Civil Register. We receive the same information about social parents and close family members who are with the child.

  • From the Danish Civil Register, we receive a self-employed person's personal identity number and other basic information.

  • From the Danish Civil Register, we receive information about company identity and ownership, including beneficial owners.

  • From the Danish Tax Agency, we receive income information used to make a decision on the obligation to pay contributions as well as business identity, ownership, business address and contact information and we may receive other financial information in connection with the recovery of amounts due.

  • From Det Digitale Tinglysningssystem (‘the Digital Land Registration System’), we receive information about ownership and liabilities relating to real estate and motor vehicles.

  • We receive information about account numbers/NemKonto and any potential exemptions from receiving Digital Post from the Danish Agency for Digitization.

  • From Udbetaling Danmark, we receive information about the self-employed person's hourly wage, working hours, maternity/paternity leave that entitles the person to maternity benefits and, if applicable, the Tax Identification Number (TIN).

How do we process your personal data?

We process your personal data on the basis of the Executive Order on the Act for Maternity/Paternity Compensation on the Private Labour Market (Bekendtgørelse af lov om barselsudligning på det private arbejdsmarked). We can obtain and coordinate data for case processing and for checking payments, etc. This can be done with the help of Udbetaling Danmark – Public Benefits Administration on the basis of special provisions in the Danish Udbetaling Danmark Act and established guidelines, including those for erasure of data. We can pass on information about you to other public authorities such as the Danish Tax Agency which, by law, are entitled to receive information.

Who do we pass on your personal data to?

We can pass on information about you to others who are entitled to receive the information, such as authorities, institutions and relevant private companies (see below). We pass on the following types of personal data about you:

  • We pass on information about payments of compensation

  • In some cases, we have to pass on your case to the Danish National Archives.

How long do we store your personal data?

We store your personal data when processing your case and we delete them after the child reaches the age of 19. The information is stored after the case has been closed due to rules in the Danish Limitation Act, the Danish Bookkeeping Act and the Danish Archiving Act. If you have consented to Barsel.dk recording a conversation, Barsel.dk deletes this conversation after two months. You can always have the conversation deleted earlier by contacting Barsel.dk.

Automated individual decisions

We may make decisions that are solely based on automated data processing. The automatic decisions are made by us collecting information from public registers which are automatically compared with information in your case and which together determine whether you are liable to contribute to Barsel.dk, whether you are entitled to compensation from Barsel.dk or whether other persons or employers related to a child with whom you have taken maternity/paternity leave are entitled to compensation or reimbursement.

What are your rights?

You can receive a copy of the data we process about you (insight) You can complain about us processing your personal data (objection) You may also request:

  • to have your personal data rectified or erased

  • to have the data sent to you or another party (data portability)

  • that we suspend the processing of your data.

And finally, you can object to us making automated decisions. If you ask to have your personal data erased, we may not be able to comply with your request. There may be conditions or limitations to the rights mentioned above. It is therefore not guaranteed that, for example, you have the right to have your personal data deleted in a specific context - this will depend on the specific circumstances in connection with the data processing. Among other things, this may be due to your personal data being used in a case involving a payment to a third party or for legal compliance reasons. If you have parental custody or parental responsibility for a child under the age of 18 and information about the child is included in the case, the child also has these rights.

  • that you have not received a satisfactory response to your request for access to your personal data

  • or if you think that Barsel.dk has not respected your rights.

Please note that the Danish Data Protection Agency is only a complaints body regarding the Barsel.dk’s processing of your personal data - it does not deal with complaints regarding the processing of your case.
